These Terms of Service (“Terms”) cover your use of the website, API, dashboard, and other services offered by Hopscotch (“Hopscotch,” “we,” “us”), including hopscotchlabs.ai and the Hopscotch API (together, the “Service”). By creating an account, adding credit, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18, or the age of majority where you live. Give us accurate account details, and keep your credentials and API keys secret. You are responsible for all activity on your account and your keys, including by teammates you invite.
If you sign up on behalf of a business, you confirm you are allowed to accept these Terms for it.
2. Credit and billing
Hopscotch is pay as you go. You add prepaid credit by card, and each request is billed from your balance at the provider's list price per token, with no markup, fees, or subscription. Provider list prices can change. A request is billed at the price in effect when it runs.
If you turn on auto top-up, we charge your card the amount you set whenever your balance drops below the threshold you choose, until you turn it off.
A promo code takes off the amount stated with it. It has no cash value.
If you use your own provider key, that provider bills you directly, and Hopscotch charges nothing for those requests.
Refunds. Credit is generally non-refundable, including credit you have not used. We may refund duplicate charges, charges caused by our own errors, or where the law requires it.
Taxes are your responsibility unless we are required to collect them. You authorize Hopscotch and our payment processor to charge your payment method for the credit you buy and any applicable taxes.
3. Acceptable use
You may not use the Service to:
- Break the law.
- Create content that exploits or sexualizes minors.
- Send spam or malware, or attack other systems.
- Impersonate others in a way meant to deceive.
- Disrupt the Service, reverse engineer it, or get around its security, rate limits, or spend limits.
You must also follow the usage policies of each provider whose models you call.
4. Enforcement
We may throttle, suspend, or close any account, with or without notice, if we believe it breaks these Terms or puts the Service, other users, or a provider at risk. We may use account, billing, and request metadata to investigate.
If we close an account for breaking these Terms, unused credit is not refunded, and we may refuse a new account from the same person, payment method, or organization. If we close an account without cause, we refund the unused credit.
You can stop using the Service and close your account at any time.
5. Your content and the models we serve
You own the prompts you send and the responses you receive. You give Hopscotch a limited license to process them only as needed to run, secure, and bill the Service, as our Privacy Policy describes.
The models are owned by their providers and come with their own terms. Your use of their outputs must follow those terms. Model outputs can be wrong, incomplete, or offensive. Check them before you rely on them.
6. Service availability and changes
We aim for high availability, but we do not promise the Service will be uninterrupted, error-free, or available at any given speed. Our Service Level Agreement sets out our uptime target and the credits it gives.
Providers can change or retire their models. We may add, remove, or change models, providers, limits, or features at any time. If a change materially reduces a paid feature you use, we will give reasonable notice first.
7. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, Hopscotch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that model outputs are accurate, safe, or fit for any particular use.
8. Limitation of liability
To the fullest extent the law allows, Hopscotch and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service.
Our total liability for all claims arising from these Terms or the Service is limited to the greater of what you paid Hopscotch in the twelve months before the event that gave rise to the claim, or US$100.
9. Indemnification
You agree to indemnify and hold Hopscotch harmless from any claim, demand, loss, or expense, including reasonable legal fees, that arises from your use of the Service in breach of these Terms or the law, or from content you submit to or generate through the Service.
10. Changes to these Terms
We may update these Terms. The current version is always posted at hopscotchlabs.ai/terms with its “Last updated” date. For material changes that affect your rights, we will give reasonable notice before they take effect, by email or in the dashboard. Using the Service after a change takes effect means you accept the updated Terms.
11. Governing law and disputes
These Terms, and any dispute arising from them or from your use of the Service, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The provincial and federal courts in Toronto, Ontario have exclusive jurisdiction, and you and Hopscotch each consent to them.
Nothing in this section limits either party's right to seek urgent relief in any court to protect intellectual property or confidential information.
